Terms of Use (EULA)

Big Screen Soulmates (the "service") is operated by Birch Bark Incense Inc. ("we", "us", "our"), a corporation incorporated under the Canada Business Corporations Act, with its registered office at 67 Third Avenue, Wawa, Ontario, P0S 1K0, Canada. By creating an account or using the service you agree to these Terms.

These Terms include a binding arbitration agreement and class-action waiver (Section 12) for users in the United States. Read them carefully; using the service means you agree to them.

1. Eligibility

You must be at least 18 years old to create an account. We verify age at signup using your date of birth and reject any signup under 18; your age is calculated from that date of birth and cannot be edited afterwards. Providing false information is grounds for immediate account termination. You must not use the service if you are a registered sex offender or barred from dating services by court order.

2. Zero tolerance for objectionable content and abusive users

The following are strictly prohibited and will result in immediate account removal:

  • Nudity, sexually explicit content, or requests for such content
  • Harassment, hate speech, threats, or intimidation
  • Impersonation, fake profiles, or catfishing
  • Spam, scams, solicitation, or commercial promotion
  • Content depicting or involving minors in any inappropriate way (immediately reported to authorities where required by law)
  • Illegal activity, violence, self-harm promotion, or dangerous content

We review every report and act on objectionable content and abusive users. Confirmed violations result in permanent account removal without refund or appeal.

3. Reporting, blocking and visibility controls

Every profile and chat includes tools to report or block. You may also report an individual message from within a conversation; doing so sends a copy of that message and the surrounding conversation to our moderators for review (see the Privacy Policy for how long moderation evidence is kept). Reports are private and the reported member is not told who reported them. Blocking hides users from each other across Discover, Matches, and messaging. You can also unmatch at any time, which removes the match and makes the conversation inaccessible to both parties.

Incognito mode hides your profile from Discover and the daily featured pick while you continue to browse, like and message. It is provided free of charge and is not a guarantee of anonymity: members you have already matched with, members you like or message, and our moderators can still see your profile. Muting a conversation and switching notifications off change only what we send you — they do not delete messages, block the sender, or notify anyone.

3a. Profile verification

Before you can browse Discover you must submit a verification selfie matching two randomly prompted poses. Submitting the selfie unlocks Discover — moderator approval is not required first. Your first accepted selfie becomes your profile photo and is visible to other members. While your submission is awaiting review your profile carries an "Awaiting verification" badge that other members can see; once a moderator approves it, the badge becomes "Verified". A verified badge means we believe a live person matching that photo controls the account — it is not an identity, criminal-record, or background check.

Automated photo screening. Every submitted selfie is checked by an AI content-safety model before a moderator sees it. Nudity, sexual content, violence, hate imagery and similar breaches are rejected automatically and never become your profile photo; repeated attempts are grounds for removal. Where the result is unclear — an obscured face, a pose that does not match the prompt — your photo is placed on hold: it is hidden from Discover until a human moderator decides, while you keep full access to browsing and the rest of the app. Every hold and appeal is decided by a person, not by the model alone.

Each account gets three free verification attempts. Only submissions that reach a human moderator count against that allowance — if the automated screen rejects your photos outright, the attempt is not deducted, and if you had paid for an extra submission it is refunded automatically. Further attempts may require a small per-submission fee (currently US$0.99). We also rate-limit verification submissions per account and per network to prevent multi-account abuse. Submitting someone else's photo, an edited or AI-generated image, or a photo already used on another account is grounds for immediate removal.

3b. Location and connection checks

The service checks where you are by asking your browser for your device location and comparing the resulting country with the country of your network connection. Your country is detected automatically and re-checked each time you open your profile page or Discover; you cannot select or type it yourself, and it updates if you move. Using any tool that misrepresents your location is prohibited. If the two checks disagree, or you decline location access, we do not lock you out: we show a banner explaining the conflict and your profile stops appearing in other members' "same country only" results until the checks agree. Persistent or deliberate location spoofing may still lead to removal. Your city is only recorded when you use "Use precise location", and is hidden from other members unless you choose to show it.

4. Your content

You are responsible for your profile, photos, and messages. You retain ownership, but grant us a worldwide, non-exclusive, royalty-free licence to host, display, and moderate this content for the purpose of operating the service. Do not post anything you do not have the right to share. We may remove content that violates these Terms.

5. Safety and assumption of risk

We provide identity verification (pose-matched selfie), country verification, and moderation, but we do not perform criminal background checks and we cannot guarantee any user's identity, intentions, or conduct offline. You acknowledge that interactions with other users — online and in person — carry risk, and that you use the service at your own risk. Follow the guidance in our Safety Center: meet in public, tell a friend, arrange your own transport, and trust your instincts.

6. Video calls

Chat supports text, movie-night invites, and video-call invites. If you use the video-call invite feature, the call itself is conducted through the third-party service you both agree on. We do not host, record, or moderate video calls. You are responsible for your own conduct on the call and for complying with any recording-consent laws that apply where you are.

7. Account deletion

You can permanently delete your account at any time from the Your account tab under Account controls. Deletion is irreversible — there is no way to recover the account afterwards. In normal circumstances it takes effect immediately. If there is an unresolved safety report about your account, we close and hide the account straight away and erase the data once moderators finish their review, and in any case within 7 days; you are told this on screen when it applies. Your login, profile, photos, favourites, likes, matches, messages, verification records, blocks you made, feedback, and referral rows are removed from our production database at once, and encrypted backups roll off within 30 days. If you want to keep your account but stop appearing to others, use Pause instead.

8. Payments & subscriptions

Browsing the website (creating a profile, verification, Discover, and matching) is free. Messaging matches — including text, movie-night invites, and video-call invites — is a paid feature and requires an active subscription, currently US$9.99 per month or US$79.99 per year for Big Screen Plus. Subscriptions are sold only inside our iOS app as auto-renewing subscriptions billed by Apple (App Store). Prices, trial length, and renewal terms are shown in-app before you confirm the purchase, and payment is charged to your Apple ID. Reading messages that a match sends you remains free on the web.

California automatic-renewal disclosure (Cal. Bus. & Prof. Code §17600 et seq.): subscriptions renew automatically for the same term at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. The renewal price, term, and frequency are shown in-app before purchase and in your Apple receipt. You can manage or cancel your subscription at any time in Settings › Apple ID › Subscriptions. Refunds are handled by Apple under its standard policies; we cannot issue refunds directly for in-app purchases.

We do not collect or process payment card details on the website. Cancelling a subscription does not delete your account — use the "Delete account" control on the Your account tab under Account controls for that.

8a. End User Licence Agreement (mobile apps)

These Terms, together with the terms below, form the End User Licence Agreement ("EULA") for the Big Screen Soulmates mobile applications. Birch Bark Incense Inc. grants you a limited, non-transferable, non-exclusive, revocable licence to use the app on any Apple- or Google-branded device you own or control, in accordance with the applicable store's usage rules. You may not copy, reverse-engineer, sublicense, or redistribute the app.

Zero tolerance for objectionable content and abusive behaviour. By installing or using the app you agree not to post objectionable content or abuse other members (see section 2). We act on every report of objectionable content or abusive behaviour within 24 hours of receipt by removing the content and ejecting the member who provided it, and members can block abusive users at any time. Continued or severe violations result in permanent removal without refund.

Apple as third-party beneficiary. This EULA is between you and Birch Bark Incense Inc. only, not Apple or Google. We — not Apple or Google — are solely responsible for the app, its content, maintenance and support, and for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal requirements, and intellectual-property claims. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any failure to conform to a warranty is Apple's only refund obligation. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government restricted-party list. You must comply with any applicable third-party terms when using the app.

9. Intellectual property

The name "Big Screen Soulmates", the logo, and all software are owned by Birch Bark Incense Inc. Film titles, posters, and metadata are the property of their respective rights holders and are provided through the OMDb API for identification purposes only.

10. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, error-free, secure, or that it will meet your requirements or result in any particular match, meeting, or relationship.

11. Limitation of liability

To the maximum extent permitted by law, in no event will Birch Bark Incense Inc., its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the service — including but not limited to interactions with other users, whether online or offline. Our total aggregate liability for any claim arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) CA$100. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Dispute resolution — arbitration and class-action waiver (US users)

If you are a resident of the United States, you and Birch Bark Incense Inc. agree that any dispute arising out of or relating to these Terms or the service will be resolved by final and binding individual arbitration administered by a recognised arbitration provider (such as JAMS or AAA) under its consumer rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and Birch Bark Incense Inc. each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative action. You may opt out of this arbitration agreement by sending written notice to support@bigscreensoulmates.com within 30 days of first accepting these Terms. If any part of this section is held unenforceable, the remainder remains in effect.

This section does not apply where prohibited by applicable law, including to (i) residents of Quebec, whose rights under the Consumer Protection Act (CQLR c. P-40.1) to bring or participate in class actions and to have disputes heard by Quebec courts are preserved; (ii) residents of other provinces of Canada or of jurisdictions where mandatory arbitration or class-action waivers are unenforceable in consumer contracts; and (iii) any claim that cannot lawfully be arbitrated.

13. Governing law and forum

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Subject to Section 12 (arbitration for US users), you and Birch Bark Incense Inc. submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, except that consumers retain the protection of the mandatory laws (including consumer-protection laws) of their province, state, or country of residence. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Language

These Terms are provided in English. The parties confirm that it is their express wish that these Terms and all related documents be drawn up in English. Les parties confirment leur volonté expresse que la présente convention et tous les documents s'y rattachant soient rédigés en anglais.

15. DMCA / copyright

If you believe content on the service infringes your copyright, send a notice to support@bigscreensoulmates.com including: identification of the work, identification of the material, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorised to act. We will act on properly formed notices.

16. Changes and termination

We may update these Terms and may suspend or terminate accounts that violate them. Continued use after changes means you accept the updated Terms.

17. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with the Privacy Policy and any in-app disclosures presented at the time of purchase, constitute the entire agreement between you and Birch Bark Incense Inc. with respect to the service and supersede any prior agreements. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
